1. Eligibility & Accounts

You must be at least 13 years old to use the Services (or older if required in your jurisdiction). If you are under 18, you represent that you have parental or guardian consent.

You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

2. User Content & License Grant

You retain ownership of content you create or post (e.g., notes, prayer requests, community comments). By posting or submitting User Content, you grant Estes Clan a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and store it solely as necessary to operate, improve, and promote the Services (including moderating community features and displaying badges).

We reserve the right to moderate, remove, or refuse any User Content that violates these Terms or our community standards (respect, truth, and love).

3. Acceptable Use & Community Guidelines

You agree not to:

• Post harmful, harassing, illegal, or profane content (we strive for a space aligned with biblical values of truth and love).

• Attempt to scrape, hack, or reverse-engineer the Services.

• Use the Services for commercial purposes without our prior written consent.

• Misrepresent your identity or impersonate others.

• Upload viruses or interfere with the Services.

Violation may result in account suspension or termination.

4. Intellectual Property

All trademarks, logos, design, code, and original content of MyBibleIQ are owned by or licensed to Estes Clan Inc. and protected by law. Bible translations and content are provided under licenses from third-party publishers — you may not redistribute them commercially.

You may not copy, modify, or create derivative works of the Services except as expressly permitted.

5. AI Assistant & Content Disclaimers

The AI assistant provides helpful responses based on your inputs and biblical resources. AI output is not a substitute for professional pastoral counseling, medical advice, or theological guidance. Always verify Scripture and consult trusted spiritual leaders. We do not guarantee accuracy or completeness.

6. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may stop using the Services at any time. Sections that by their nature should survive (e.g., liability, IP, arbitration) will continue after termination.

7. Disclaimers & Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or specific spiritual outcomes.

To the fullest extent permitted by law, Estes Clan Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or spiritual distress) arising from your use of the Services, even if advised of the possibility. Our total liability shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold Estes Clan Inc. harmless from any claims, losses, or damages arising from your violation of these Terms, your User Content, or your use of the Services.

9. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Florida (or Delaware as the state of incorporation, where applicable), without regard to conflict of laws principles.

Any dispute shall first attempt informal resolution. If unresolved, disputes will be resolved by binding arbitration in Palm Beach County, Florida, administered by the American Arbitration Association under its Commercial Arbitration Rules. You agree to waive any right to a jury trial or class action.

You may also bring claims in small claims court in Palm Beach County, Florida.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app, website, or email. Your continued use after the effective date constitutes acceptance.

11. Miscellaneous

If any provision is invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and Estes Clan regarding the Services and supersede prior agreements.
